By placing an order on shop.gutstronomy.co.za, you confirm that you have read, understood, and agree to these Terms & Conditions in full. If you do not agree, please do not use the shop.

1. About Us

Gutstronomy (Pty) Ltd ("Gutstronomy", "we", "us", "our") is a South African company registered and operating from Ballito, KwaZulu-Natal, South Africa. We manufacture and sell fermented foods, kefir products, bone broths, and related whole food products directly to consumers.

All transactions on this website are subject to South African law.

2. Orders

All orders placed through our online shop are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including where product errors or pricing errors have occurred.

On placing an order you will receive an automated order confirmation. This does not constitute acceptance — acceptance occurs when your order is confirmed by Marilyn directly via email or WhatsApp.

You must be 18 years or older to place an order.

3. Pricing

All prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable. Prices are correct at the time of display but may be updated at any time without notice. The price confirmed at checkout is the price you will be charged.

Bulk discount pricing (10% off on orders of 6 or more of the same product) is applied automatically at checkout.

4. Payment

Payments are processed securely through PayFast, a PCI-compliant South African payment gateway. We do not store your payment card information. Accepted payment methods include credit and debit cards, EFT, and other methods made available by PayFast.

Your order will only be dispatched or prepared for collection once payment has been confirmed.

5. Perishable Products

All Gutstronomy products are fresh, fermented, or frozen perishable goods. As such, special conditions apply:

  • Products must be refrigerated or frozen immediately upon receipt.
  • Shelf life and storage instructions are provided on each product label — please follow them strictly.
  • We are not liable for spoilage resulting from improper storage after delivery or collection.
  • Because our products are food items prepared for consumption, they cannot be returned once delivered unless they arrive in a damaged or spoiled condition that is our fault (see Returns Policy).

6. Intellectual Property

All content on this website including text, images, logos, product descriptions, and the Gutstronomy brand is the intellectual property of Gutstronomy (Pty) Ltd. No content may be reproduced, distributed, or used commercially without prior written permission.

7. Limitation of Liability

Gutstronomy products are food supplements and fermented foods, not medicines. Nothing on our website constitutes medical advice. If you have a medical condition, are pregnant, or are on medication, please consult a qualified healthcare practitioner before consuming our products.

To the maximum extent permitted by law, Gutstronomy's liability for any claim arising from use of our products is limited to the purchase price of the relevant product.

8. Governing Law

These terms are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and the Protection of Personal Information Act 4 of 2013 (POPIA).

Privacy Policy

This policy explains how Gutstronomy (Pty) Ltd collects, uses, stores, and protects your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Information We Collect

When you place an order or contact us, we collect the following personal information:

  • Full name and surname
  • Email address
  • Cellphone number
  • Delivery address (street, city, province, postal code)
  • Order history and product preferences
  • Payment confirmation details (we do not store card numbers)

We do not collect sensitive personal information (as defined by POPIA) unless specifically required and consented to.

2. How We Use Your Information

We use your personal information only for the following purposes:

  • Processing and fulfilling your order
  • Communicating order status, delivery arrangements, and collection times
  • Responding to queries and support requests
  • Sending order confirmations and receipts
  • Improving our products and services
  • Complying with legal obligations

We do not sell, trade, or rent your personal information to third parties for marketing purposes.

4. Data Retention

We retain your personal information for as long as necessary to fulfil the purposes for which it was collected, including for legal, accounting, and reporting requirements. Order records are retained for a minimum of 5 years as required by South African tax legislation.

5. Your Rights Under POPIA

You have the right to:

  • Request access to the personal information we hold about you
  • Request correction of inaccurate personal information
  • Request deletion of your personal information (subject to legal retention obligations)
  • Object to the processing of your personal information
  • Lodge a complaint with the Information Regulator of South Africa

6. Cookies

Our shop uses browser localStorage to temporarily store your basket contents between pages. No tracking cookies or third-party advertising cookies are set by us. PayFast may set cookies during the payment process — please refer to their privacy policy for details.

Consumer Protection Act Compliant

Returns & Refunds

Effective date: 1 January 2024  ·  Gutstronomy (Pty) Ltd

Important: Because all Gutstronomy products are fresh, perishable food items, our returns policy is necessarily limited in scope. Please read this carefully before placing an order.

1. Perishable Goods — General Rule

As a general rule, we cannot accept returns of perishable food products once they have been delivered or collected. This is in accordance with Section 19(9) of the Consumer Protection Act, which permits exclusion of the right to return goods that are perishable and were not defective at the time of supply.

2. When We Will Accept a Return or Issue a Refund

Notwithstanding the above, we will offer a replacement or full refund in the following circumstances:

  • Products arrived damaged or spoiled — where damage occurred during delivery and was not caused by improper handling after receipt.
  • Wrong product delivered — where you received a different product to what you ordered.
  • Short supply — where you received fewer items than ordered and paid for.
  • Product was defective at time of supply — where a product does not meet reasonable quality standards through no fault of the customer.

To qualify, you must notify us within 24 hours of receipt with photographic evidence sent to marilyn@gutstronomy.co.za. Claims submitted after 24 hours cannot be considered as we are unable to verify the condition of perishable goods.

3. Order Cancellations

Orders may be cancelled and fully refunded if cancellation is requested before the order has been prepared. Because our products are made fresh to order, once preparation has begun a cancellation may not be possible.

4. Refund Processing

Approved refunds are processed back to the original payment method within 5–7 business days. PayFast processing timelines may apply. You will be notified by email once your refund has been processed.

5. Change of Mind

We are unable to accept returns or issue refunds where you have simply changed your mind about a purchase. Given the perishable nature of our products and the fact that each order is prepared fresh, this is not practically possible.

Shipping Policy

1. Delivery Areas

We currently offer direct delivery to the following areas:

2. Long-Distance Delivery

Due to the cold-chain requirements of our fresh and fermented products, we do not currently offer standard nationwide courier delivery. However, we have made successful arrangements to deliver to Cape Town, Pretoria, and other locations.

3. Collection

Collection from Ballito is always welcome and free of charge. Once your order is confirmed and ready, Marilyn will contact you directly to arrange a suitable collection time and location.

4. Delivery Conditions

  • Deliveries are made Monday to Saturday during business hours.
  • You will be contacted to confirm a delivery window before we head out.
  • Please ensure someone is available to receive perishable goods. We cannot leave refrigerated or frozen items unattended.
  • If a delivery attempt fails due to no one being available, a redelivery fee may apply.

5. Order Processing Times

All products are made fresh. Once payment is confirmed, please allow 1–2 business days for your order to be prepared before dispatch. You will receive communication from us directly during this time.

6. Liability for Delivery

We take care to ensure products are packed appropriately for transit. Once a delivery has been completed and signed for (or acknowledged), responsibility for proper storage passes to the customer. We are not liable for spoilage resulting from improper storage after receipt.

1. Introduction

The Promotion of Access to Information Act 2 of 2000 ("PAIA") gives effect to Section 32 of the Constitution of the Republic of South Africa, which provides for the right of access to information. This manual is compiled in accordance with Section 51 of PAIA and applies to Gutstronomy (Pty) Ltd.

4. How to Submit a Request for Access to Information

A request for access to records held by Gutstronomy must be made using the prescribed Form C (available from the SAHRC or the South African Government website). The completed form must be submitted to the Information Officer by:

The request must include sufficient detail to identify the record sought, the form in which access is required (e.g. copy, inspection), and the requestor's contact details. A request fee may be applicable as prescribed by the relevant regulations.

5. Grounds for Refusal

In terms of PAIA, Gutstronomy may refuse access to records in certain circumstances, including where disclosure would:

  • Unreasonably expose individuals to harm
  • Involve commercially sensitive or confidential third-party information
  • Prejudice the safety of individuals
  • Constitute an infringement of another person's right to privacy
  • Conflict with any other applicable legislation
